KHC FAQ
From time to time, we offer a short Q & A on KHC-related issues:
1. Why is a waiver required to participate in KHC Events?
The waiver we use is tied to our insurance coverage and risk management program. Our Hike Leaders and Directors are volunteers and if something goes wrong on an event, we are both insured (general commercial public liability) and protected from potential court and damage costs with the power of a signed legal waiver. We use an electronic waiver but the content was developed in conjunction with the Federation of Mountain Clubs of BC, on the professional advice of risk management lawyers and insurance brokers. Without high levels of protection, our key volunteers could not step safely forward to lead KHC events.
2. Is an electronic waiver a legal waiver?
The laws in BC were revised to support e-commerce, online services, and online consent forms. They are upheld within our courts and are as valid as paper versions.
3. Why do I need to Agree to KHC Guidelines and Expectations within the waiver and for each event for which I register?
When a member signs up for the Club and for each event, we want each member to understand what to expect during any KHC event, but we also want the member to read the event listing carefully and to understand what he/she is signing up for. By asking for the agreement each time we are reinforcing the principle of informed consent.
4. Do Guests have to complete a waiver too?
All Guests must also sign a waiver. No Waiver, no participation with no Exceptions. Bringing Guests on events actually increases our risks since they may not be fully informed about the event, nor our Guidelines and Expectations.
5. Why do we need to sign a new waiver each year?
We have been advised that the expectation is consistent with Best Practices in risk management.
